Kitchnd Terms of Service

Welcome to Kitchnd! These Terms of Service ("Terms") govern your access to and use of the Kitchnd mobile application ("App"). By creating an account or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use Kitchnd.

1. Acceptance of Terms

By accessing or using Kitchnd, you confirm that:

• You are at least 16 years old
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and truthful

2. Description of Service

Kitchnd is a location-based social networking app designed to connect pickleball players. The App allows you to:

• Create a profile with your skill level, bio, and preferences
• Discover nearby pickleball players based on location
• Send and receive direct messages with other users
• Post player requests to find partners for sessions
• Share photos, videos, and files through chat

3. User Accounts

Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 16 years old to create an account
• One person may not maintain more than one account
• You may not impersonate any person or entity

Account Security

• You are solely responsible for all activities that occur under your account
• Notify us immediately at [email protected] if you suspect unauthorized access
• We are not liable for any loss or damage arising from your failure to protect your account

Account Termination

• You may delete your account at any time through the app settings
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon termination, your right to use the App immediately ceases

4. User Conduct

Acceptable Use
You agree to use Kitchnd only for lawful purposes. You will NOT:

• Harass, abuse, threaten, or intimidate other users
• Post or share illegal, harmful, offensive, or inappropriate content
• Use the App to solicit commercial activities unrelated to pickleball
• Misrepresent your identity, age, skill level, or location
• Create fake profiles or automated accounts (bots)
• Attempt to hack, reverse engineer, or compromise the App's security
• Scrape, collect, or store other users' personal information
• Spam other users with unsolicited messages or requests

Content Standards
All content you share must:

• Comply with applicable laws and regulations
• Respect other users' privacy and intellectual property rights
• Not contain nudity, sexually explicit material, or graphic violence
• Not promote hate speech, discrimination, or illegal activities
• Not include viruses, malware, or harmful code

Reporting Violations
If you encounter content or behavior that violates these Terms, please report it to [email protected].

5. User-Generated Content

Content Ownership

• You retain ownership of all content you create, upload, or share on Kitchnd
• By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content to provide the App's services

Content Responsibility

• You are solely responsible for the content you share
• We do not endorse, support, or guarantee the accuracy of user-generated content
• We reserve the right (but have no obligation) to remove content that violates these Terms

Content Removal
We may remove content without notice if it:

• Violates these Terms or our Privacy Policy
• Infringes on intellectual property rights
• Is reported by other users as inappropriate
• Poses a safety or security risk

6. Location Services

Location Data

• Kitchnd uses your GPS location to help you find nearby players
• Location sharing is user-controlled — you must manually update your location via the "Use Current Location" button
• We do not continuously track your location in the background
• Your approximate location (distance from other users) is shown to other users to facilitate connections

Location Accuracy

• Location data is provided "as is" and may not always be accurate
• You are responsible for verifying meeting locations and arrangements with other users
• We are not responsible for any issues arising from inaccurate location data

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains:

• What information we collect
• How we use and share your data
• Your rights regarding your personal information
• How to contact us with privacy concerns

By using Kitchnd, you consent to our data practices as described in the Privacy Policy.

8. Third-Party Services

Kitchnd integrates with third-party services, including:

• Supabase (authentication, database, storage)
• Stream Chat (messaging infrastructure)
• Firebase (crash reporting, push notifications)

We are not responsible for the practices or policies of third-party services.

9. Intellectual Property

Our Rights

• The Kitchnd name, logo, design, and all app content (excluding user-generated content) are owned by Kitchnd or our licensors
• You may not copy, modify, distribute, or create derivative works without our written permission

Trademarks
"Kitchnd" and the Kitchnd logo are trademarks. You may not use our trademarks without prior written consent.

10. Disclaimers and Limitations of Liability

No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Fitness for a particular purpose
• Accuracy, reliability, or availability of the App
• Freedom from errors, viruses, or harmful components

User Interactions

• You are solely responsible for your interactions with other users
• We do not conduct background checks on users
• We are not responsible for the conduct of any user, whether online or offline
• Use caution and common sense when meeting users in person

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability to you shall not exceed AUD $100
• We are not liable for loss of data, revenue, profits, or business opportunities

User Responsibility
You acknowledge and agree that:

• You meet other users at your own risk
• You take appropriate safety precautions when meeting in person
• You verify the identity and intentions of other users before sharing personal information
• We are not responsible for any harm, injury, or damages arising from user interactions

11. Indemnification

You agree to indemnify, defend, and hold harmless Kitchnd, its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the App
• Your content or conduct on the App
• Your interactions with other users

12. In-App Purchases and Subscriptions

Current Status
Kitchnd is currently free to use. We do not currently offer in-app purchases or subscriptions.

Future Premium Features
We may introduce paid features in the future, such as:

• Manual location search
• Ability to post multiple player requests
• Priority placement in discovery results

If we introduce paid features:

• Pricing will be clearly displayed before purchase
• Subscriptions will auto-renew unless cancelled
• Refunds will be subject to Apple App Store or Google Play Store policies

13. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of this page
• We will notify you through the App or via email
• Continued use of the App after changes constitutes acceptance of the new Terms
• If you do not agree to the modified Terms, you must stop using the App

14. Termination

Your Rights
You may terminate your account at any time by:

• Going to Settings > Account Actions > Delete Account
• Following the account deletion process
• Your data will be deleted within 30 days as described in our Privacy Policy

Our Rights
We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• Your conduct poses a risk to other users or the App
• We are required to do so by law
• We decide to discontinue the App

Effect of Termination
Upon termination:

• Your right to access and use the App immediately ceases
• We may delete your data in accordance with our Privacy Policy
• Sections of these Terms that should reasonably survive termination will remain in effect

15. Governing Law and Dispute Resolution

Governing Law
These Terms are governed by the laws of Australia, specifically the laws applicable in the state of Victoria, without regard to conflict of law principles.

Dispute Resolution
If you have a dispute with Kitchnd:

1. Contact Us First: Email [email protected] to attempt to resolve the issue informally
2. Mediation: If informal resolution fails, both parties agree to attempt mediation before pursuing legal action
3. Jurisdiction: Any legal proceedings must be brought in the courts of Victoria, Australia

Class Action Waiver
You agree to resolve disputes on an individual basis. You waive any right to participate in a class action or representative proceeding.

16. Miscellaneous

Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kitchnd regarding the App.

Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service failures.
